建设工程企业资质管理制度改革方案

建设工程企业资质管理制度改革方案

  为贯(guan)彻落实(shi)2019年(nian)全(quan)(quan)国深(shen)(shen)化“放(fang)管服(fu)”改革优化营商(shang)环(huan)境电(dian)视电(dian)话会议精神(shen)和李克(ke)强总理重要讲话精神(shen),按照《国务院办公厅关(guan)于印发全(quan)(quan)国深(shen)(shen)化“放(fang)管服(fu)”改革优化营商(shang)环(huan)境电(dian)视电(dian)话会议重点任务分工方案的通知》(国办发〔2019〕39号)要求,深(shen)(shen)化建筑业(ye)“放(fang)管服(fu)”改革,做好(hao)建设工程企业(ye)资质(zhi)(包括工程勘(kan)察、设计、施工、监理企业(ye)资质(zhi),以下(xia)统(tong)称企业(ye)资质(zhi))认定事项压减工作,现(xian)制定以下(xia)改革方案。

  一、指导思想(xiang)

  以习近平新(xin)时代中(zhong)(zhong)国特色社会主(zhu)义思(si)想为(wei)指(zhi)导(dao),贯彻落实(shi)党的(de)十(shi)九大和(he)十(shi)九届二中(zhong)(zhong)、三中(zhong)(zhong)、四中(zhong)(zhong)、五中(zhong)(zhong)全会精神,充(chong)分发挥市场在(zai)资源配置中(zhong)(zhong)的(de)决定性作用,更好发挥政(zheng)府作用,坚持(chi)以推(tui)进建(jian)筑(zhu)(zhu)业(ye)供给侧(ce)结(jie)构(gou)性改(gai)(gai)革为(wei)主(zhu)线(xian),按照国务院深化(hua)(hua)(hua)“放管服”改(gai)(gai)革部署(shu)要(yao)求,持(chi)续优化(hua)(hua)(hua)营商(shang)环境,大力精简企(qi)业(ye)资质类别,归并等级设置,简化(hua)(hua)(hua)资质标准(zhun),优化(hua)(hua)(hua)审(shen)批方(fang)式,进一步放宽(kuan)建(jian)筑(zhu)(zhu)市场准(zhun)入限(xian)制(zhi),降低制(zhi)度性交易(yi)成本,破除制(zhi)约(yue)企(qi)业(ye)发展的(de)不合理(li)束(shu)缚(fu),持(chi)续激发市场主(zhu)体活力,促进就业(ye)创业(ye),加快推(tui)动(dong)建(jian)筑(zhu)(zhu)业(ye)转(zhuan)型升级,实(shi)现高质量发展。

  二、主(zhu)要内容

  (一(yi))精简资(zi)(zi)(zi)(zi)(zi)(zi)(zi)质(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)类别(bie),归并等(deng)(deng)级(ji)设(she)置。为在疫情(qing)防控常(chang)态化(hua)条件(jian)下做好(hao)“六稳(wen)”工(gong)(gong)(gong)作、落实“六保”任务(wu)(wu),进(jin)(jin)(jin)一(yi)步优化(hua)建筑(zhu)市场(chang)营商环境,确(que)保新(xin)旧资(zi)(zi)(zi)(zi)(zi)(zi)(zi)质(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)平稳(wen)过(guo)渡(du),保障工(gong)(gong)(gong)程质(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)量安全,按照稳(wen)中(zhong)求(qiu)进(jin)(jin)(jin)的(de)原则,积极稳(wen)妥推进(jin)(jin)(jin)建设(she)工(gong)(gong)(gong)程企(qi)业(ye)(ye)(ye)资(zi)(zi)(zi)(zi)(zi)(zi)(zi)质(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)管理制度改(gai)革(ge)。对(dui)部分(fen)(fen)(fen)专(zhuan)业(ye)(ye)(ye)划分(fen)(fen)(fen)过(guo)细、业(ye)(ye)(ye)务(wu)(wu)范围相近、市场(chang)需求(qiu)较(jiao)小(xiao)的(de)企(qi)业(ye)(ye)(ye)资(zi)(zi)(zi)(zi)(zi)(zi)(zi)质(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)类别(bie)予以(yi)合(he)(he)(he)并,对(dui)层级(ji)过(guo)多的(de)资(zi)(zi)(zi)(zi)(zi)(zi)(zi)质(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)等(deng)(deng)级(ji)进(jin)(jin)(jin)行归并。改(gai)革(ge)后,工(gong)(gong)(gong)程勘(kan)察资(zi)(zi)(zi)(zi)(zi)(zi)(zi)质(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)分(fen)(fen)(fen)为综合(he)(he)(he)资(zi)(zi)(zi)(zi)(zi)(zi)(zi)质(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)和专(zhuan)业(ye)(ye)(ye)资(zi)(zi)(zi)(zi)(zi)(zi)(zi)质(zhi)(zhi)(zhi)(zhi)(zhi)(zhi),工(gong)(gong)(gong)程设(she)计资(zi)(zi)(zi)(zi)(zi)(zi)(zi)质(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)分(fen)(fen)(fen)为综合(he)(he)(he)资(zi)(zi)(zi)(zi)(zi)(zi)(zi)质(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)、行业(ye)(ye)(ye)资(zi)(zi)(zi)(zi)(zi)(zi)(zi)质(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)、专(zhuan)业(ye)(ye)(ye)和事务(wu)(wu)所(suo)资(zi)(zi)(zi)(zi)(zi)(zi)(zi)质(zhi)(zhi)(zhi)(zhi)(zhi)(zhi),施(shi)工(gong)(gong)(gong)资(zi)(zi)(zi)(zi)(zi)(zi)(zi)质(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)分(fen)(fen)(fen)为综合(he)(he)(he)资(zi)(zi)(zi)(zi)(zi)(zi)(zi)质(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)、施(shi)工(gong)(gong)(gong)总承(cheng)(cheng)包(bao)(bao)资(zi)(zi)(zi)(zi)(zi)(zi)(zi)质(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)、专(zhuan)业(ye)(ye)(ye)承(cheng)(cheng)包(bao)(bao)资(zi)(zi)(zi)(zi)(zi)(zi)(zi)质(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)和专(zhuan)业(ye)(ye)(ye)作业(ye)(ye)(ye)资(zi)(zi)(zi)(zi)(zi)(zi)(zi)质(zhi)(zhi)(zhi)(zhi)(zhi)(zhi),工(gong)(gong)(gong)程监理资(zi)(zi)(zi)(zi)(zi)(zi)(zi)质(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)分(fen)(fen)(fen)为综合(he)(he)(he)资(zi)(zi)(zi)(zi)(zi)(zi)(zi)质(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)和专(zhuan)业(ye)(ye)(ye)资(zi)(zi)(zi)(zi)(zi)(zi)(zi)质(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)。资(zi)(zi)(zi)(zi)(zi)(zi)(zi)质(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)等(deng)(deng)级(ji)原则上压减为甲、乙(yi)两级(ji)(部分(fen)(fen)(fen)资(zi)(zi)(zi)(zi)(zi)(zi)(zi)质(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)只设(she)甲级(ji)或不分(fen)(fen)(fen)等(deng)(deng)级(ji)),资(zi)(zi)(zi)(zi)(zi)(zi)(zi)质(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)等(deng)(deng)级(ji)压减后,中(zhong)小(xiao)企(qi)业(ye)(ye)(ye)承(cheng)(cheng)揽业(ye)(ye)(ye)务(wu)(wu)范围将进(jin)(jin)(jin)一(yi)步放宽,有利于促进(jin)(jin)(jin)中(zhong)小(xiao)企(qi)业(ye)(ye)(ye)发展(zhan)。具(ju)体压减情(qing)况如下:

  1.工(gong)(gong)程(cheng)勘察资(zi)(zi)质。保留综(zong)合(he)资(zi)(zi)质;将(jiang)4类(lei)专业资(zi)(zi)质及劳务资(zi)(zi)质整(zheng)合(he)为(wei)岩土(tu)工(gong)(gong)程(cheng)、工(gong)(gong)程(cheng)测(ce)量(liang)、勘探测(ce)试等3类(lei)专业资(zi)(zi)质。综(zong)合(he)资(zi)(zi)质不分等级,专业资(zi)(zi)质等级压(ya)减为(wei)甲、乙(yi)两(liang)级。

  2.工程设计资(zi)(zi)(zi)质(zhi)(zhi)(zhi)(zhi)。保留综合(he)资(zi)(zi)(zi)质(zhi)(zhi)(zhi)(zhi);将21类(lei)(lei)行(xing)业(ye)资(zi)(zi)(zi)质(zhi)(zhi)(zhi)(zhi)整(zheng)合(he)为14类(lei)(lei)行(xing)业(ye)资(zi)(zi)(zi)质(zhi)(zhi)(zhi)(zhi);将151类(lei)(lei)专(zhuan)业(ye)资(zi)(zi)(zi)质(zhi)(zhi)(zhi)(zhi)、8类(lei)(lei)专(zhuan)项(xiang)资(zi)(zi)(zi)质(zhi)(zhi)(zhi)(zhi)、3类(lei)(lei)事务(wu)所(suo)资(zi)(zi)(zi)质(zhi)(zhi)(zhi)(zhi)整(zheng)合(he)为70类(lei)(lei)专(zhuan)业(ye)和(he)事务(wu)所(suo)资(zi)(zi)(zi)质(zhi)(zhi)(zhi)(zhi)。综合(he)资(zi)(zi)(zi)质(zhi)(zhi)(zhi)(zhi)、事务(wu)所(suo)资(zi)(zi)(zi)质(zhi)(zhi)(zhi)(zhi)不(bu)分(fen)等级;行(xing)业(ye)资(zi)(zi)(zi)质(zhi)(zhi)(zhi)(zhi)、专(zhuan)业(ye)资(zi)(zi)(zi)质(zhi)(zhi)(zhi)(zhi)等级原则上压(ya)减为甲(jia)、乙两级(部分(fen)资(zi)(zi)(zi)质(zhi)(zhi)(zhi)(zhi)只设甲(jia)级)。

  3.施工(gong)(gong)资(zi)(zi)(zi)(zi)质(zhi)。将10类施工(gong)(gong)总(zong)承(cheng)(cheng)包(bao)(bao)(bao)企(qi)业(ye)特级资(zi)(zi)(zi)(zi)质(zhi)调整为(wei)施工(gong)(gong)综合资(zi)(zi)(zi)(zi)质(zhi),可承(cheng)(cheng)担各行业(ye)、各等(deng)级施工(gong)(gong)总(zong)承(cheng)(cheng)包(bao)(bao)(bao)业(ye)务(wu);保(bao)留12类施工(gong)(gong)总(zong)承(cheng)(cheng)包(bao)(bao)(bao)资(zi)(zi)(zi)(zi)质(zhi),将民航工(gong)(gong)程的专(zhuan)业(ye)承(cheng)(cheng)包(bao)(bao)(bao)资(zi)(zi)(zi)(zi)质(zhi)整合为(wei)施工(gong)(gong)总(zong)承(cheng)(cheng)包(bao)(bao)(bao)资(zi)(zi)(zi)(zi)质(zhi);将36类专(zhuan)业(ye)承(cheng)(cheng)包(bao)(bao)(bao)资(zi)(zi)(zi)(zi)质(zhi)整合为(wei)18类;将施工(gong)(gong)劳务(wu)企(qi)业(ye)资(zi)(zi)(zi)(zi)质(zhi)改为(wei)专(zhuan)业(ye)作业(ye)资(zi)(zi)(zi)(zi)质(zhi),由审批制改为(wei)备案制。综合资(zi)(zi)(zi)(zi)质(zhi)和专(zhuan)业(ye)作业(ye)资(zi)(zi)(zi)(zi)质(zhi)不分(fen)等(deng)级;施工(gong)(gong)总(zong)承(cheng)(cheng)包(bao)(bao)(bao)资(zi)(zi)(zi)(zi)质(zhi)、专(zhuan)业(ye)承(cheng)(cheng)包(bao)(bao)(bao)资(zi)(zi)(zi)(zi)质(zhi)等(deng)级原则上压减为(wei)甲、乙两级(部分(fen)专(zhuan)业(ye)承(cheng)(cheng)包(bao)(bao)(bao)资(zi)(zi)(zi)(zi)质(zhi)不分(fen)等(deng)级),其中(zhong),施工(gong)(gong)总(zong)承(cheng)(cheng)包(bao)(bao)(bao)甲级资(zi)(zi)(zi)(zi)质(zhi)在本行业(ye)内(nei)承(cheng)(cheng)揽(lan)业(ye)务(wu)规模不受限制。

  4.工程(cheng)监理(li)资(zi)质(zhi)(zhi)(zhi)。保留综(zong)(zong)合资(zi)质(zhi)(zhi)(zhi);取消专业(ye)资(zi)质(zhi)(zhi)(zhi)中(zhong)的水利(li)水电工程(cheng)、公(gong)路工程(cheng)、港口与航道工程(cheng)、农林工程(cheng)资(zi)质(zhi)(zhi)(zhi),保留其余10类专业(ye)资(zi)质(zhi)(zhi)(zhi);取消事务所资(zi)质(zhi)(zhi)(zhi)。综(zong)(zong)合资(zi)质(zhi)(zhi)(zhi)不分(fen)等级(ji)(ji),专业(ye)资(zi)质(zhi)(zhi)(zhi)等级(ji)(ji)压减为(wei)甲、乙两(liang)级(ji)(ji)。

  (二)放(fang)(fang)宽(kuan)准入限制,激发企(qi)(qi)业(ye)(ye)活力。住(zhu)房(fang)和(he)城(cheng)乡建设(she)部会同(tong)国务(wu)院有关主管(guan)部门(men)制定(ding)统一的(de)企(qi)(qi)业(ye)(ye)资(zi)(zi)质(zhi)标准,大幅精(jing)简审批条件(jian),放(fang)(fang)宽(kuan)对企(qi)(qi)业(ye)(ye)资(zi)(zi)金(jin)、主要人(ren)员、工程(cheng)业(ye)(ye)绩(ji)和(he)技术装备(bei)等的(de)考核要求。适当(dang)放(fang)(fang)宽(kuan)部分(fen)(fen)资(zi)(zi)质(zhi)承揽业(ye)(ye)务(wu)规模(mo)上限,多个(ge)资(zi)(zi)质(zhi)合(he)并(bing)的(de),新资(zi)(zi)质(zhi)承揽业(ye)(ye)务(wu)范(fan)(fan)围(wei)相(xiang)应扩大至整合(he)前各(ge)资(zi)(zi)质(zhi)许可范(fan)(fan)围(wei)内的(de)业(ye)(ye)务(wu),尽(jin)量(liang)减(jian)少政(zheng)府对建筑(zhu)市场(chang)微观活动的(de)直接(jie)干预,充分(fen)(fen)发挥市场(chang)在(zai)资(zi)(zi)源(yuan)配置(zhi)中(zhong)的(de)决定(ding)性(xing)作用(yong)。

  (三)下(xia)放(fang)审(shen)批(pi)(pi)(pi)权(quan)限,方便企(qi)(qi)业(ye)办事。进一步加大(da)放(fang)权(quan)力度,选择工(gong)作(zuo)基础(chu)较(jiao)好的地方和部分资(zi)(zi)质(zhi)类(lei)别,开展企(qi)(qi)业(ye)资(zi)(zi)质(zhi)审(shen)批(pi)(pi)(pi)权(quan)下(xia)放(fang)试点,将(jiang)除综合资(zi)(zi)质(zhi)外的其(qi)他(ta)等级资(zi)(zi)质(zhi),下(xia)放(fang)至省(sheng)级及(ji)以下(xia)有(you)关主管部门审(shen)批(pi)(pi)(pi)(其(qi)中,涉(she)及(ji)公路(lu)、水(shui)运、水(shui)利(li)、通(tong)信、铁路(lu)、民航(hang)等资(zi)(zi)质(zhi)的审(shen)批(pi)(pi)(pi)权(quan)限由(you)国(guo)务院住房和城乡建设(she)主管部门会同国(guo)务院有(you)关部门根据实际情况决定(ding)(ding)),方便企(qi)(qi)业(ye)就近办理。试点地方要明确专门机构、专业(ye)人员负责企(qi)(qi)业(ye)资(zi)(zi)质(zhi)审(shen)批(pi)(pi)(pi)工(gong)作(zuo),并制定(ding)(ding)企(qi)(qi)业(ye)资(zi)(zi)质(zhi)审(shen)批(pi)(pi)(pi)相关管理规定(ding)(ding),确保资(zi)(zi)质(zhi)审(shen)批(pi)(pi)(pi)权(quan)下(xia)放(fang)后地方能够(gou)接得(de)住、管得(de)好。企(qi)(qi)业(ye)资(zi)(zi)质(zhi)全(quan)国(guo)通(tong)用,严(yan)禁(jin)各行(xing)(xing)业(ye)、各地区(qu)设(she)置(zhi)限制性措施,严(yan)厉查处变相设(she)置(zhi)市场准入壁(bi)垒,违(wei)规限制企(qi)(qi)业(ye)跨地区(qu)、跨行(xing)(xing)业(ye)承揽业(ye)务等行(xing)(xing)为,维护统一规范的建筑市场。

  (四)优化(hua)审(shen)批(pi)(pi)服(fu)务,推(tui)行告(gao)知(zhi)承(cheng)诺制(zhi)。深化(hua)“互联网(wang)(wang)+政务服(fu)务”,加(jia)快(kuai)推(tui)动企(qi)业(ye)(ye)资(zi)(zi)质(zhi)(zhi)(zhi)审(shen)批(pi)(pi)事项(xiang)线上(shang)办(ban)理,实(shi)行全程网(wang)(wang)上(shang)申报和审(shen)批(pi)(pi),逐步(bu)推(tui)行电子资(zi)(zi)质(zhi)(zhi)(zhi)证(zheng)书,实(shi)现(xian)企(qi)业(ye)(ye)资(zi)(zi)质(zhi)(zhi)(zhi)审(shen)批(pi)(pi)“一(yi)网(wang)(wang)通(tong)(tong)办(ban)”,并在(zai)全国(guo)建筑市(shi)场(chang)监管公(gong)共(gong)服(fu)务平台公(gong)开(kai)发布(bu)企(qi)业(ye)(ye)资(zi)(zi)质(zhi)(zhi)(zhi)信(xin)息(xi)。简化(hua)各类证(zheng)明(ming)事项(xiang),凡是通(tong)(tong)过政府部(bu)门间(jian)信(xin)息(xi)共(gong)享可(ke)以获取的证(zheng)明(ming)材料,一(yi)律(lv)不再(zai)要求企(qi)业(ye)(ye)提供。加(jia)快(kuai)推(tui)行企(qi)业(ye)(ye)资(zi)(zi)质(zhi)(zhi)(zhi)审(shen)批(pi)(pi)告(gao)知(zhi)承(cheng)诺制(zhi),进一(yi)步(bu)扩(kuo)大告(gao)知(zhi)承(cheng)诺制(zhi)使用范(fan)围,明(ming)确(que)审(shen)批(pi)(pi)标准,逐步(bu)提升企(qi)业(ye)(ye)资(zi)(zi)质(zhi)(zhi)(zhi)审(shen)批(pi)(pi)的规(gui)范(fan)化(hua)和便利(li)化(hua)水平。

  (五)加强事中事后监(jian)(jian)管(guan),保障工程质量安全。坚持放管(guan)结(jie)合,加大资质审批(pi)后的(de)动(dong)态监(jian)(jian)管(guan)力度(du),创(chuang)新监(jian)(jian)管(guan)方式和(he)(he)手段(duan),全面推行(xing)“双(shuang)随机(ji)、一公开”监(jian)(jian)管(guan)方式和(he)(he)“互联网+监(jian)(jian)管(guan)”模(mo)式,强化工程建设(she)各方主体责(ze)(ze)任(ren)落(luo)实,加大对转包(bao)、违法分包(bao)、资质挂靠等违法违规行(xing)为查(cha)处力度(du),强化事后责(ze)(ze)任(ren)追究,对负(fu)有工程质量安全事故责(ze)(ze)任(ren)的(de)企业、人员(yuan)依(yi)法严厉追究法律(lv)责(ze)(ze)任(ren)。

  三、保(bao)障措施

  (一)完善工(gong)程(cheng)招投标制度,引导(dao)(dao)建设(she)(she)单位合(he)理选择企(qi)业(ye)(ye)(ye)。持续(xu)深化(hua)工(gong)程(cheng)招投标制度改(gai)革,完善工(gong)程(cheng)招标资格审查制度,优(you)化(hua)调整(zheng)工(gong)程(cheng)项(xiang)目招标条件设(she)(she)置,引导(dao)(dao)建设(she)(she)单位更多从企(qi)业(ye)(ye)(ye)实力(li)(li)、技(ji)术力(li)(li)量、管理经验等方(fang)面进行综合(he)考(kao)察(cha),自主选择符(fu)合(he)工(gong)程(cheng)建设(she)(she)要(yao)求的企(qi)业(ye)(ye)(ye)。积极培(pei)育(yu)全过程(cheng)工(gong)程(cheng)咨询服务(wu)机构,为(wei)业(ye)(ye)(ye)主选择合(he)格企(qi)业(ye)(ye)(ye)提供专业(ye)(ye)(ye)化(hua)服务(wu)。大(da)力(li)(li)推(tui)行工(gong)程(cheng)总承(cheng)包,引导(dao)(dao)企(qi)业(ye)(ye)(ye)依法自主分包。

  (二)完善职业(ye)资格管(guan)(guan)理制度(du),落实注(zhu)册(ce)人(ren)员(yuan)责(ze)(ze)任。加快修订完善注(zhu)册(ce)人(ren)员(yuan)职业(ye)资格管(guan)(guan)理制度(du),进一步明确注(zhu)册(ce)人(ren)员(yuan)在工(gong)程(cheng)建设(she)活动(dong)中的权(quan)利(li)、义务和责(ze)(ze)任,推动(dong)建立个(ge)人(ren)执业(ye)责(ze)(ze)任保险制度(du),持续规范执业(ye)行为,落实工(gong)程(cheng)质量(liang)终身责(ze)(ze)任制,为提升工(gong)程(cheng)品质、保障安全生(sheng)产提供有力支(zhi)撑。

  (三)加强(qiang)监督指(zhi)导,确(que)保(bao)改革措施(shi)落地(di)。制(zhi)定建(jian)设工(gong)程企(qi)业(ye)(ye)资(zi)质标(biao)准(zhun)指(zhi)标(biao)说明,进一步细化(hua)审(shen)(shen)批(pi)标(biao)准(zhun)和要求,加强(qiang)对(dui)地(di)方审(shen)(shen)批(pi)人员的培训,提升(sheng)资(zi)质审(shen)(shen)批(pi)服(fu)务能(neng)力和水(shui)平。不定期对(dui)地(di)方资(zi)质审(shen)(shen)批(pi)工(gong)作进行(xing)抽查,对(dui)违规审(shen)(shen)批(pi)行(xing)为严(yan)肃处理,公开(kai)曝光,情节严(yan)重的,取消企(qi)业(ye)(ye)资(zi)质审(shen)(shen)批(pi)权下放试点资(zi)格。
